Terms and Conditions for EMJota Studio

Welcome to EMJota Studio! These Terms and Conditions (“Terms”) govern your use of our website https://emjotastudio.com/ (the “Site”) and your purchase of products from EMJota Studio (hereinafter referred to as “we”, “us”, “our”, or “EMJota Studio”). By accessing or using our Site and purchasing our products, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or purchase our products.
EMJota Studio is based in Portugal and primarily sells custom-made clothing items internationally.

- Site Language: The primary language of the Site and these Terms is English.
- Governing Law: These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Portugal.
- Use of the Site
- Eligibility: By using this Site, you represent that you are at least 16 years old, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this Site.
- Account Registration: To access certain features of the Site, such as making a purchase or creating a wishlist, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your account.
- Prohibited Conduct: You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. This includes, but is not limited to: transmitting any worms or viruses or any code of a destructive nature; infringing upon or violating our intellectual property rights or the intellectual property rights of others; submitting false or misleading information; or collecting or tracking the personal information of others.
- Products and Orders
- Product Descriptions: We strive to be as accurate as possible in the descriptions of our products. However, we do not warrant that product descriptions or other content on the Site are entirely accurate, complete, reliable, current, or error-free. The pieces shown are representations of how your piece will look. As items are custom-made, slight variations may occur.
- Custom Orders: Most our pieces are made to order according to your specific measurements and preferences as indicated during the ordering process. It is your responsibility to provide accurate measurements.
- Production Time: Custom orders typically take approximately 30-35 days to be completed. This includes the time in the queue and the production time of the piece. This is an estimate and may be subject to change. We advise placing orders for special events at least 6-7 weeks in advance.
- Order Acceptance: We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in the description or price of the product, or error in your order. If we cancel an order after you have already been billed, we will issue a refund to your original payment method.
- Modifications to Services and Prices: Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.
- Payment
- Payment Methods: We accept Credit/Debit Cards (Visa, Mastercard,), PayPal*, MB Way (for Portugal) and Multibanco Reference as payment methods.
- Currency: All prices are listed in Euros (€). If you are purchasing from outside the Eurozone, your card issuer or payment provider will apply their own exchange rates.
- Full Payment: Full payment is required before an order is processed and production begins.
- Taxes and Duties: For international orders, you are responsible for any import duties, customs fees, and local taxes that may be applied by your country’s authorities. These are not included in the item price or shipping cost.
(*) Paypal: Paypal charges an additional 3.95% fee for every transaction. If this is the selected payment method, this tax will be added to your final balance.
- Shipping and Delivery
- Shipping Policy: All the orders are sent via local post (handled by CTT-Correios de Portugal until it leaves Portugal and distributed by the destination country’s official post office company). The shipping cost isn’t included in the piece’s price, calculated based on the package’s weight and its destination. All the parcels are tracked: Portugal orders are estimated to arrive 1-3 days after shipping, European orders 1 week after shipping and the rest of the world 2 weeks after shipping.
- Shipping Address: You are responsible for providing an accurate and complete shipping address. We are not responsible for orders shipped to incorrect addresses provided by the customer.
- Destination’s Exclusions: Exclusions to ship to certain countries may apply, according to CTT’s policies.
- Risk of Loss: The risk of loss and title for items purchased pass to you upon our delivery to the carrier.
- Delays: We are not responsible for shipping delays caused by the carrier, customs clearance, or other circumstances beyond our reasonable control.
- Returns, Exchanges, and Cancellations
- Policy for Custom-Made Items:
- No Returns/Exchanges: Due to the personalized nature of the items, all sales are final, and no returns or exchanges are accepted unless the item is faulty (manufacturing defects) or not as described/ordered.
- Cancellations: All the orders can be cancelled within 24 hours (cancellation fees may apply).
- Faulty or Incorrect Items: If you receive an item that is faulty, damaged, or significantly different from what you ordered, please contact us within 7 days of receiving your order with photographic evidence. We will assess the issue and, if validated, offer a suitable solution, which may include a repair, replacement, or refund.
- Process for Approved Returns: In case of return, the condition of the item must be pristine (unworn) and it should be packaged carefully to insure its protection. The return must be completed within a month (counting after the parcel is shipped to the customer) for a valid refund/replacement. The return’s assessment starts only after receiving the item back and the sender must bear the shipping costs.
- Intellectual Property
All content on this Site, including but not limited to text, graphics, logos, images, designs, and software, is the property of EMJota Studio or its content suppliers and is protected by Portuguese and international copyright and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent.
- User Content
If you submit reviews, comments, photos, or other content to the Site (“User Content”), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. You represent and warrant that you own or otherwise control all ofthe rights to the User Content that you post.
- Limitation of Liability
To the fullest extent permitted by applicable law, EMJota Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Site or products; (b) any conduct or content of any third party on the Site; (c) any content obtained from the Site; or (d) unauthorized access, use, or alteration of your transmissions or content.
Our liability for any claim arising out of or relating to our products or your use of the Site shall not exceed the purchase price of the product in question.
- Indemnification
You agree to defend, indemnify, and hold harmless EMJota Studio and its owner, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your User Content, any use of the Site’s content, services, and products other than as expressly authorized in these Terms.
- Disclaimer of Warranties
Your use of the Site and its products is at your sole risk. The Site and products are provided on an “AS IS” and “AS AVAILABLE” basis. EMJota Studio expressly disclaims all warranties of any kind, whether express, implied, or statutory, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that (a) the Site or products will meet your requirements; (b) the Site will be uninterrupted, timely, secure, or error-free; (c) the results that may be obtained from the use of the Site or products will be accurate or reliable; or (d) the quality of any products, services, information, or other material purchased or obtained by you through the Site will meet your expectations. You are absolutely responsible for ensuring the garment’s care to guarantee its longevity.
- Dispute Resolution
- Governing Law: These Terms shall be governed by the laws of Portugal.
- Amicable Resolution: We encourage you to contact us first to seek a resolution for any dispute or claim. We will try to resolve any disputes with you quickly and efficiently.
- Online Dispute Resolution (EU Consumers): If you are a consumer residing in the European Union, you have the right to submit your complaint to an Online Dispute Resolution platform managed by the European Commission. You can access this platform here: https://ec.europa.eu/consumers/odr.
- Litigation: If we cannot resolve a dispute using our internal complaint handling procedure, or if you are not satisfied with the outcome, you have the right to take legal action. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts of Portugal. - Severability
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
